Why Businesses Need Lawyers

If you own a small business you might be thinking about the kind of staffing and guidance you need to help your business succeed. There are a lot of people who can help take a business from the bottom to the top but since your money and your time are precious you have to take the very necessary people and forget the rest.

For this reason taking a lawyer on retainer might be the best thing you can do for your business. Yes, there are times when taking legal council doesn’t make much sense but when you are talking about a new business venture it helps to have someone who has a full working knowledge of the law to be there to help you in case you get into a situation that you are not familiar with.

A lawyer isn’t needed nor does it make sense to have one in all businesses. For instance, if you are opening up an online business that deals in design or freelance writing the number of problems you can get into as far as those that will affect you legally are few and far between so having a lawyer on retainer just doesn’t seem to make sense.

However if you are going to be doing things that involve serious advertising, signing of contracts, building or taking control of property than you need to have some sort of legal counsel just to make sure that you are doing everything right. There is no reason why you shouldn’t do things to right way and protect your bottom line.

 

The Changing Prospects of Being a Lawyer

There was a time when there was no better career than being a lawyer but those days are long and gone. Now, don’t confuse this at all: being a lawyer certainly is a worthwhile profession, but there is a darker side to the job market these days that is having people take a second look at whether or not they want to go to law school.

In the last decade there has been a rise in the number of lawyers, while at the same time there has been a decline in the number of lawyers needed. Many people, especially with the help of the internet, are not needing to hire lawyers or seek counsel as much as they were in the past. Now what that has done is it has created a flood of the law profession and it’s keeping good hard working lawyers from finding work. Even when they do find work they are seeing that there is not always the same paycheck they used to see. With some many in the field its no longer specialized and they can therefore reduce the amount they pay lawyers.

Now some will still go to law school because they love the law and it’s what they have always wanted to do but the truth of the matter is that these lawyers are having second thoughts because while the paychecks are getting smaller, the cost to get into law school isn’t getting any smaller. Now it will take that much longer to pay back a student loan and make things that much more difficult. All in all there are a lot of reasons to think about not becoming a lawyer.

Understanding the Solvent Idea

The legal system in the United States has plenty of checks and balances in it to make sure that anyone who is accused of a crime, no matter how big or small, can be afforded proper legal representation. However, while many people think that the government will help anyone in the middle of a legal dispute there are some things to know.

First, when you are read your rights they will tell you “if you do not have an attorney one will be presented to you,” but that’s not exactly the case. The truth of the matter is that you cannot just cry poor and be afforded a lawyer. You have to prove that you are, beyond the shadow of a doubt, solvent. This means that you are going to have to submit bank record and other notifications to prove that you are without the funds to seek legal guidance.

Now, you might be thinking that this is a terrible way to behave but the truth of the matter is that it’s the way it has to be. Those lawyers that are provided to you are provided by tax payer money. That means you are putting them into the system. Of course you only want people who need it to have them. Without that you are in a very serious situation where the tax money is being wasted on people who don’t need free legal help. The law is there to protect everyone but at the same time it has to protect it’s own tax dollars.
